It is mutually agreed that the following terms of agreement form an integral part of this contract and that no variation or modification of this contract shall be effective unless accepted by both Kathryn Chapman Photography (‘KCP’) and the Client, in writing.

PAYMENT
Payment for all packages must be made either prior to or on the date of engagement. KCP accepts bank transfer, cheque (payable to Kathryn Chapman) or cash.

POST & PACKING
Prints and/or digital images on disc will be sent via Royal Mail First Class within the timescale advised by KCP. Other items such as albums will be posted Royal Mail First Class Recorded where a signature will be required.

CREATIVE LICENCE
KCP shall be granted creative and artistic licence in relation to the choice of locations and poses used. KCP’s judgment on photographic style and the number of photographs taken shall be deemed correct. Some photographs may not be possible due to changes of the weather and the availability and willingness of subjects. KCP will do her best to honour requested photographs but do not undertake to guarantee any specific picture nor incorporate any specific background, location or group arrangement.

COPYRIGHT
The 1998 Copyright, Designs, and Patents Act assigns copyright to KCP. You may not copy the photographs taken under this contact, or allow copies to be made photographically, electronically or by any other means without written consent from KCP.

FORCE MAJEURE
In the unlikely event of total photographic failure, injury or sickness beyond KCP’s control, their liability shall be limited to a full refund of all monies paid. Your statutory rights are not affected.

CANCELLATION
If KCP has to cancel an appointment for reasons beyond her control (death, injury, sickness, etc.), their liability shall be limited to a full refund of all monies paid. If the Client cancels the appointment an unconditional refund policy exists up until 48 hours prior to the reserved slot at which point a cancellation fee of 20% of the total fees will be required.

POSTPONEMENT
Should the cancelled appointment turn out to be a postponement, then, subject to KCP’s availability, all monies paid may be applied to the new appointment. In this case, the total fees chargeable shall be the fee which applies at that time. If that appointment is then subsequently cancelled, a cancellation fee of 20% of the total fees will become payable.

POSTPONEMENT DUE TO ADVERSE WEATHER
If the appointment has to be cancelled due to adverse weather conditions a new, mutually agreed appointment will be made. No cancellation fee will be charged.

COMPLAINTS PROCEDURE

PRIVACY
KCP will store your name and address details on a private internal database. These details will be used to update you on KCP offers and events only and will not be made available to third parties under any circumstance. Should you wish to have your details removed from this database, please advise in writing.
